terms of service

by using bemyroomie ("the service") you agree to these terms. if you don't agree, don't use the service.

1. what bemyroomie is

bemyroomie is a discovery and introduction platform. we verify that users own the email address they sign up with (via a confirmation link or Google sign-in), we host listings that users choose to post, and we surface those listings on a map and listings page. when both parties opt in, we reveal contact info so they can talk to each other directly off-platform.

bemyroomie is not:

• a party to any lease, sublease, or rental agreement
• a payment processor — no money flows through the platform, no rent, deposits, escrow, or transaction fees
• a real estate agent, broker, or property manager — we are not licensed and we do not act as one
• a tenant-screening service — "verified" means email-verified, not background-checked
• a guarantor of the truthfulness, safety, or legality of any listing

2. who can use the service

you must be at least 18 years old and provide a working email address that you can receive verification mail at. one account per person. don't share credentials.

3. your content

you keep ownership of the listings, photos, videos, and other content you post. by posting, you grant bemyroomie a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the service to other users. you represent that you have the right to share anything you post and that it is accurate.

listings must be for housing you have the legal right to lease or sublet. we may remove any listing at our discretion.

4. anti-discrimination

you may not post or solicit listings that exclude or prefer tenants on the basis of race, color, religion, national origin, disability, sex, familial status, sexual orientation, marital status, or source of income (in Massachusetts).

gender-based roommate preferences for shared living spaces are permitted as a matter of personal privacy, consistent with applicable fair-housing law. all other protected-class preferences are not.

we may remove listings or terminate accounts that violate this section without notice.

5. things you must not do

• post listings for properties you don't have the right to lease
• collect or solicit payment for application fees, holding deposits, or rent through bemyroomie
• scrape, automate, or bulk-access the service
• impersonate another person or misrepresent your enrollment
• harass or threaten other users
• upload content that infringes third-party rights or violates the law

6. your responsibility — meet safely

you are solely responsible for verifying that any listing, apartment, or person you contact through bemyroomie is real, legal, and safe before paying anything, signing anything, or meeting in person. we do not pre-screen listings beyond basic format checks. always:

• visit the apartment in person before paying
• verify the lister is actually authorized to lease the unit
• never wire money or send gift cards based on a listing
• report suspicious listings to safety@bemyroomie.app

7. limitation of liability

the service is provided "as is" and "as available". to the maximum extent permitted by law, bemyroomie disclaims all warranties (express or implied) and is not liable for any indirect, incidental, special, or consequential damages — including damages arising from fraudulent listings, bad actors, lost rent, eviction, or disputes with roommates or landlords.

our total liability for any claim arising out of or relating to these terms or the service will not exceed one hundred U.S. dollars ($100).

8. indemnification

you agree to indemnify and hold bemyroomie harmless from any claims arising from your content, your use of the service, and your violation of these terms or applicable law.

9. account termination

we may suspend or terminate your account at any time for any reason, including (without limitation) violations of these terms, abuse, fraud, or extended inactivity. you can close your account at any time by emailing privacy@bemyroomie.app.

10. copyright / DMCA

if you believe content on bemyroomie infringes your copyright, send a takedown notice to dmca@bemyroomie.app including: identification of the work, the infringing URL, your contact info, a good-faith statement, a statement under penalty of perjury that you are the rights holder or authorized agent, and your signature.

11. changes

we may update these terms from time to time. material changes will be announced via email to verified users at least seven days before they take effect. continued use of the service after the effective date constitutes acceptance.

12. governing law

these terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. exclusive jurisdiction and venue for any dispute lies in the state or federal courts located in Suffolk County, Massachusetts.
